In the case of an adult, the need to establish a guardianship typically arises because of advanced age or incapacity and there is no power of attorney delegating authority to someone to make decisions.
In order to become a guardian, a petition must be filed in court. Guardianship is usually granted to the incapacitated person's spouse. In the absence of a spouse, or if the spouse is unwilling or unable to serve as guardian, the court considers parents, siblings, adult children, other relatives or friends.
Guardian of the Property
A court-appointed guardian of the property is responsible for making financial decisions and for managing the income, liabilities and assets, including real estate, of the injured person. Detailed accounting records must be filed with the court annually.
Guardian of the Person
A court appointed guardian of the person is responsible for making personal and medical decisions on behalf of the incapacitated person. It is not unusual for one person to serve as both guardian of the person and guardian of the property, or for more than one person to be appointed to share the responsibilities.
