What is Probate?

Probate is the process by which, if there is a will, the court supervises the transfer of assets from the deceased's estate to their intended beneficiaries. If no valid will exists, then the court decides how the property should be distributed. The process of probate is also designed to make sure that the estate's taxes and creditors are paid in the appropriate order.

There are two types of probate. In an informal probate there is minimal court intervention. Usually, this process is reserved for smaller estates where no one is contesting the contents of the will or any supporting estate planning documents. Formal probate is reserved for more complex estates where there are more assets, supporting documents and especially if there are any disputes among the beneficiaries.
